Terms and Conditions

These Terms and Conditions govern the use of the GRIDWORK platform at gw4.me and the app at app.gw4.me. This is a convenience translation; in case of doubt the German version prevails.

§ 1 — Scope

These Terms and Conditions apply to your use of the GRIDWORK platform. By creating an account and/or using the services you agree to these Terms. The version valid at the time the contract is concluded shall apply.

§ 2 — Description of services

GRIDWORK provides a web-based platform for the visualisation and control of photovoltaic, wallbox and related energy components. Average availability is ≥ 99 % per calendar month. There is no claim to permanent availability, in particular in the event of force majeure, maintenance work or disruptions of upstream services.

§ 2a — Tariff optimization, third-party price data & delineation from energy supply

GRIDWORK's tariff and charging optimization is a pure software optimization service: recommending and/or controlling the charging time based on third-party price data and PV availability. GRIDWORK is not an energy supplier, not an electricity provider, not an energy broker or trader and not a metering point operator. No energy supply contract is concluded between GRIDWORK and you through this use; your electricity supply contract exists solely between you and your energy supplier.

Displayed exchange and energy prices (including your surcharge) are non-binding information and optimization values. GRIDWORK assumes no warranty for the accuracy, completeness or availability of price data obtained from third parties (e.g. aWATTar, EPEX Spot) and gives no supply or billing guarantee. No calibration-law-relevant billing by kWh takes place (cf. German Measurement and Calibration Act, MessEG).

§ 3 — Account creation and sign-in

To create an account, you enter your e-mail address at app.gw4.me/auth and confirm the privacy notice and the age confirmation. Your account is created as soon as you submit your e-mail address. You then receive a one-time confirmation link by e-mail; this link is valid for 10 minutes and can be used only once. Clicking the link proves that you control your e-mail mailbox and signs you in for the first time; you then set your account password (at least 12 characters). Only once a password is set can you sign in subsequently. The e-mail address is the unique account identifier; a separate username is not required.

For subsequent sign-ins you use your credentials (e-mail address and account password) at app.gw4.me/login. In addition, you may at any time request a one-time login link to your registered e-mail address — technically the same link, likewise valid for 10 minutes and usable only once. This login link is a convenience option and does not replace the account password.

As long as you have not used the confirmation link and have not set a password, you cannot sign in and the account is without function. You may request deletion of your account at any time, informally, at hallo@gw4.me; details on storage periods are set out in the privacy notice.

§ 4 — Account security, password and responsibility for your mailbox

The security of your account depends on the confidentiality of your account password and on the security of your e-mail mailbox: the optional login link and password resets are delivered through that mailbox. You are responsible for keeping your account password secret and for protecting your e-mail access against unauthorised use (strong password, two-factor authentication recommended).

If you lose access to the stored e-mail mailbox, your account can no longer be recovered automatically. In that case please contact hallo@gw4.me for a manual review. GRIDWORK accepts no liability for damages resulting from unauthorised access to your e-mail mailbox or from sharing your account password.

Confirmation and login links are valid for 10 minutes and can be used only once; password reset links are valid for 1 hour. For security reasons the number of login links that can be requested is limited (at most 3 requests per e-mail address per hour and 20 per IP address per hour); password resets are rate-limited as well. After several failed sign-in attempts the account is temporarily locked.

§ 5 — Conclusion of contract

The contract between you and GRIDWORK is concluded when you click the confirmation link sent by e-mail. By doing so you also confirm the processing of your data in accordance with the privacy notice and the applicability of these Terms. You may terminate the contract at any time without notice period by deleting your account or sending a corresponding e-mail to hallo@gw4.me.

§ 6 — Availability, updates, maintenance

GRIDWORK may continue to develop the platform at any time, in particular to fix security vulnerabilities or to adapt to legal requirements. Functional changes will, where reasonable, be communicated in advance. Maintenance windows are scheduled outside peak usage times where possible.

§ 7 — Liability

GRIDWORK is liable without limitation for damages resulting from intent and gross negligence as well as for damages arising from injury to life, body or health. Otherwise, liability is limited to the contract-typical, foreseeable damage. There is no liability for indirect damages, lost profits or data loss, to the extent permitted by law.

§ 8 — Changes to these Terms

GRIDWORK may amend these Terms to the extent necessary for legal or technical reasons. Material changes will be communicated to you by e-mail at least 30 days before they take effect. If you do not object within this period, the amended Terms are deemed accepted. In the event of objection, the contractual relationship ends when the changes take effect.

§ 9 — Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
